Message Russ, I think all of this might be what we need..... some venting....

You are one to talk about reverse engineering. The day you left you took a JWT 16 bit ECU and told us you were going to figure it out for the good of us all. Now that you ahve started this spat you are unveiling this great 16 bit ECU upgrade as your own. Sure you added some cool features but you worked off the JWT.

Actually, I didn't. I dont make the boards or design the ones used in my 16-bit upgrade, but I did develop the programs as they are not the same. I am BUYING the daughterboards from a supplier and providing my programs on them.

I've been doing a lot of dyno testing lately in the afternoons and I have a lot of interesting results about certain JWT vs Ash Tunes. Don't get me wrong on average yours are better but a few of the programs aren't, in fact they really need some revision. You and I know that not every one of your tunes has actually been dyno tested (well most of them have been now, by Z1). Some are just built on assumptions from other programs.

Not all cars are the same and it is not uncommon to see that program "a" works really well while on a different car it appears to have a problem, but program 'b' works just fine on car #2. This is why tuning a car will always provide the results you desire. Can you elaborate on the assumptions you are referring to? I have never made any assumptions with my ECU programming.

As far as us selling AshSpec programs, yes we are selling all the remaining chips we had purchased from you. We had a large drawer full of them. We are also selling JWT chips on our site (go look and see). On top of that we are actively pursuing development of our own chips which everyone knows by now isn't really that difficult with the right equipment. Plus we have our own dyno with A/F etc and unlimited time to develop optimal tunes on. To be honest with you they are going to be "better" than your chips simply because we have the resources to make them better. We have an almost unlimited # of cars with different set-ups and we don't have to pay $100/hr for dyno time. Almost all the Z shops have their own line of ECU upgraded nowdays, and considering we are the largest why wouldn't we?

I find it hard to believe that Z1 has any of my EPROMs left over. The last batch of EPROMs you purchased from me was in early November and there were only 3-4 of them which were already sold. I dont mean to sound arrogant, but I know my programs sell significantly better than that. It sounds to me as though you are just copying my programs to get through the development of your own. Just for the record, are you using the ZEM to develop these programs? It is prohibited by the EULA.

And you really loose in respect in the eyes of all the guys at Z1 when you talk about agreements. You told us all that the DOOLZ was Z1's and the brake kits weren't even a question. It isn't like those brake kits are an awesome feat of engineering that no one could come up with. Robert and John always get a kick out of that story. Wanna call them liars also? You really think Robert just makes stuff up like that?

Russell, you and I made the agreements, not Robert and I, not anyone other. You and I knew exactly what was said and you are simply using Robert's interpretation to your advantage. I am not calling Robert a liar or a cheat or anything of the sort; I believe that Robert has his interpretation of what you and I agreed upon. Robert will also tell you that when he asked about product ownership, I clearly stated that "What I developed prior to working with Z1 is mine and if I leave, it will go with me. What I develop while I am with Z1 will stay with Z1 if I leave." I know he heard those exact words. You and I both know what we agreed upon. Besides, why would I have gone to such effort to get the DOOLZ finished before July 1st, 2003 if I were just going to give it to you? I would have just waited and let you pick up the tab for the development. Shawn and Jason who were also present at the agreement would be pleased to correct your opportunistic translation.

What gets me the most is you actually told your investors that you and I had no agreements on the DOOLZ for profit sharing what-so-ever.. And then I found an old email where you explicitly stated what the profit sharing would be. I presented this to your investors when you tried to stiff me on the profit share for the DOOLZ after I resigned - saying that I "made up the profit sharing agreement" just to get money from you. Your word is as good as nothing to me, Russell.
